DNA submissions

In June 2011, the Supreme Court voted to allow police to take DNA samples from offenders arrested for a felony. Previously, under the 4th Amendment, DNA samples were only allowed to be taken after conviction of a crime. However, police were able to convince the court that DNA samples were no more intrusive than taking fingerprints and, when submitted to a database, could help speed up the process of identifying offenders, as well as deter offenders released on bail from continuing to offend, since now their DNA was in the database.
Opponents argued that this violated 4th amendment rights because the collection of a DNA sample could be considered as evidence, even though the offender had not yet been convicted. However, the Supreme Court weighed the public’s right to safety against the individual’s right to privacy and found “that DNA sample collection for violent crime arrests supported by probable cause is a legitimate police booking procedure—like fingerprinting or photographing—and does not violate the suspects 4th Amendment rights” (National conference of State Legislators, 2013, p 1).
