Persuasive Brief: Outline and Research List Assignment

Overview
Before writing a brief, an attorney will conduct thorough research on the issue before the court. Then, the attorney will draft an outline of the brief, incorporating the research found along with the arguments to be made. This process helps the attorney to systematically see which arguments will be made and what the law in support of those arguments will be.

In preparation for filing the Persuasive Brief: Final Assignment, start by researching the issue involved in the case. For guidance, review the Persuasive Brief: General Instructions found in the Persuasive Brief: Outline and Research List Resources. Use the provided judicial opinion, relevant jury instruction, and the provided statute to guide your research. Look for at least two additional cases from this jurisdiction (state court – Illinois) to support our client’s case. Try to find cases that were published since the People v. S.M. decision came down.
 
After your research is completed, prepare an outline of how you will address the arguments before the court while incorporating the relevant law (cases, statute, and jury instruction).
 
The Persuasive Brief: Outline and Research List Assignment must include the following elements:
 
(1)  Outline: The outline provides a general outline of the argument section for your persuasive brief. Each case/statute that you will use in the argument must be included within the outline, along with a brief description (2–4 sentences) of how the case/statute will be used in the Persuasive Brief: Final Assignment.
 
(2)  Within the outline, provide a current Bluebook citation of each case and statute you intend to include in the Persuasive Brief: Final Assignment. Citations of at least 3 judicial opinions (cases) and 1 statute must be included in the list. The list must include the case and statute the paralegal staff has already given you. For ease, this list can be included throughout the outline, rather than as a reference list at the end of the assignment.
